Welcome to MailConfirmed, a service provided by Brillisoft. By accessing or using our API, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
1. Use of the API
Brillisoft grants you a limited, non-exclusive, and revocable license to access and use the MailConfirmed API strictly in accordance with these terms. You agree to use the API solely for lawful purposes and in a way that does not infringe upon the rights of, restrict, or inhibit anyone else's use and enjoyment of the API.
2. User Responsibilities
As an API user, you are responsible for:
- Ensuring the security of your API key and any credentials used to access the API.
- Using the API only for legitimate, authorized, and legal purposes.
- Not engaging in any activity that disrupts or attempts to interfere with the API’s functionality, security, or availability.
- Accurately disclosing to your end-users how their data is collected, used, and processed in compliance with all applicable privacy laws.
3. Data Privacy
You must handle any data collected, processed, or accessed through the MailConfirmed API in compliance with applicable data protection laws and regulations. By using the API, you agree to our Privacy Policy, which explains how Brillisoft collects, uses, and protects personal information.
4. Intellectual Property
All intellectual property rights in the MailConfirmed API and associated materials are owned by Brillisoft or its licensors. You may not modify, copy, distribute, or create derivative works of any part of the API without prior written permission from Brillisoft.
5. Fees and Payment
Access to the MailConfirmed API may be subject to subscription fees. By subscribing to a paid plan, you agree to the pricing, payment, and billing policies set forth by our third-party platform, RapidAPI. All fees are non-refundable except as required by law.
6. Service Limitations and Modifications
Brillisoft reserves the right to modify, suspend, or discontinue the MailConfirmed API or any of its features at any time without notice or liability. We may also impose limits on usage, quotas, or access to the API without prior notice.
7. Disclaimer of Warranties
The MailConfirmed API is provided "as-is" and "as available" without any warranties of any kind, either express or implied. Brillisoft does not guarantee that the API will be error-free, uninterrupted, or secure. You assume all risk for any damages that may result from your use of the API.
8. Limitation of Liability
To the fullest extent permitted by law, Brillisoft, its affiliates, and its suppliers shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from or in connection with your use of the API, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from or related to these terms or the API will be limited to the amount you paid, if any, for use of the API in the past 12 months.
9. Termination
Brillisoft reserves the right to suspend or terminate your access to the MailConfirmed API at any time for any reason, including but not limited to a violation of these Terms of Service. Upon termination, your right to use the API will immediately cease.
10. Changes to Terms of Service
Brillisoft may revise these Terms of Service from time to time. Any changes will be posted on this page, and significant changes will be communicated to you via email or through a prominent notice on our website. Your continued use of the API after any changes constitutes acceptance of the revised terms.
11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Israel, without regard to its conflict of law principles. Any legal actions related to the use of the API shall be brought in the courts located in Tel Aviv, Israel.
